Google Denied Trademark For Nexus One Name
The Internet is currently buzzing with the U.S. Patent and Trademark office (USPTO) denial of Google’s application to trademark the Nexus One. The denial has to do with a registered mark No. 3554195 for the word Nexus, filed on behalf of Integra Telecom Holdings, Inc., a communications company based in Portland Oregon. Their trademark application was submitted on 10/28/05 and registered on 12/30/08.
The basis for the denial is the likelihood for confusion between the two names. The description of good/services provided for the mark registration of Nexus can also be used to describe the use of the Nexus One phone.
The trademark on Nexus One is particularly important to Google at this point in time, since it is currently selling the Android phone for use on T-Mobile, AT&T, and Rogers Wireless Networks in its Web store. Additionally, Google yesterday announced its inclusion of Sprint support for Nexus One this spring and there is mention of including Verizon and Vodafone 3G networks later this year.
This is not the final determination of Google’s trademark application for Nexus One, but Google will have to respond to any issues that initially caused USPTO to deny the application.
